29 CFR 1910.28(b)(1)(i): Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: a) Roof of the Chemistry Lab; On or about August 22, 2023, and at times prior, the employer exposed employees to fall hazards, in that employees are required to go on the roof of the chemistry lab to turn the water to production on and off as well as to retrieve containers to fulfill production orders while the roof of the lab does not contain guardrails. b) Powder Tank Platform; On or about August 22, 2023, and at times prior, the employer exposed employees to fall hazards, in that employees are required to go onto the platform to produce chemical batches, in which the sides of the platform are left unguarded on certain sections leaving a fall of more than 4 feet to the ground level. c) Wastewater Tank Platform; On or about August 22, 2023, and at times prior, the employer exposed employees to fall hazards, in that employees are required to go onto the platform to produce chemical batches, in which the sides of the platform are left unguarded on certain sections leaving a fall of more than 4 feet to the ground level. d) Cleaner Tank Platform; On or about August 22, 2023, and at times prior, the employer exposed employees to fall hazards, in that employees are required to go onto the platform to produce chemical batches, in which the sides of the platform are left unguarded on certain sections leaving a fall of more than 4 feet to the ground level.
