29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access: a) Lot 17 of the Schooners Landing development in, Selbyville, DE 19801: On or about August 14, 2023, employees used ladders that did not extend at least 3 feet above the upper landing to access the upper levels of a multi-story building, exposing them to fall hazards approximately 13 feet above the ground. The employer Miguel Nunez also known as Major Builders and/or Blue Ladder was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053 (B)(1), which was contained in OSHA inspection number 1551869, citation number 1, item number 3 and was affirmed as a final order on 04/05/2022, with respect to a workplace located at Plantation Lakes Development, Lot 1140, MILLSBORO, DE 19966.
