29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) Production Floor and Laydown Yard: On or about July 31, 2023, and at times prior, the employer exposed employees to struck-by hazards, in that powered industrial truck operator training and evaluation was not provided to all employees who operate the "Toyota" model 8FGCU32 propane forklift (Serial # 61660) and the "Toyota" model 8FD45U diesel forklift (Serial # 10270) to move lumber from the storage area to the production area and to move lumber within the production area.
