29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information on paragraph (d) of this section) before use of UU3 deluge system. a) On May 15, 2023 and at times prior thereto, in the Marathon Galveston Bay Refinery in Texas City, Texas the employer did not repair the deluge system in a timely manner and did not implement additional measures to ensure safe working conditions for UU3 employees when the deluge system water valve had been blocked in because it had not been repaired. b) On May 15, 2023 and at times prior thereto, in the Marathon Galveston Bay Refinery in Texas City, Texas the employer did not repair broken disc-paks "Shims" in a timely manner and did not implement additional measures to ensure safe working conditions for UU3 employees.
