29 CFR 1910.176(b): Material stored in tiers was not stacked, blocked, interlocked or limited in height so that it was stable and secure against sliding and collapse: a) Warehouse Storage Racking: On or about March 9, 2023, employees working in the warehouse were exposed to being struck by materials (e.g., ceramic tiles, etc.) that were not stored in a stable and secure manner on overhead warehouse storage racking due to loose tile being stored on pallets, tile stored on broken/damaged pallets, tile stored on pallets not positioned in an stable manner (e.g., at a slant) and pallets of tile that were double-stacked. b) Warehouse at Exit Door - West-Side of Building: On or about March 9, 2023, employees working in the warehouse were exposed to being struck by long metal strips which were stored loosely and leaned against wall within 6 inches of the exit door and were not stored in a stable/secure manner. For instance a: In addition to abatement certification, the employer is required to submit abatement documentation for this item. Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19. Note: Instance b was documented in the inspection file as corrected during the inspection on or about 3/17/23 and therefore the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
