29 CFR 1910.146(d)(9): The employer did not develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and for preventing unauthorized personnel from attempting a rescue: The employer failed to develop and implement procedures for rescuing entrants from permit spaces and failed to develop procedures to prevent unauthorized personnel from attempting a confined space rescue. On or about March 2, 2023, an employee collapsed in a confined space and a second employee entered the space and collapsed while attempting a rescue. The employer had not developed or trained employees on how to rescue employees from confined spaces, such as the #4029 Mississippi Tank Company manufactured tanker trailer, exposing them to atmospheric hazards, such as oxygen deficiency and flammable gasses. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
