29 CFR 1910.1025(j)(1)(i): The employer did not institute a medical surveillance program for all employees who are or may be exposed at or above the action level for more than 30 days per year: On or about February 28, 2023 Thoughtful Craftsmen failed to establish a medical surveillance program for employees who are or may be exposed to lead at or above the action level of 30 micrograms per cubic meter of air for more than 30 days per year. a) On February 28, 2023, an employee tasked with stripping the old paint of window frames in the window tuning room was exposed to a time weighted average (TWA) of 52.937 micrograms per cubic meter of air for lead, approximately 23 micrograms per cubic meter above the action level. Sampling accounted for the period of 337 minutes, and zero exposure was assumed for the remaining 143 minutes.
