29 CFR 1910.134(l)(1):The employer shall conduct evaluations of the workplace as necessary to ensure that the provisions of the current written program are being effectively implemented and that it continues to be effective. a. As of August 22, 2022, for operators and other employees who processed solid wastes in the Solid Processing Pits at the facility, the employer did not conduct an annual evaluation of the workplace to ensure that the provisions of the current written respiratory protection program were being effectively implemented and that it continued to be effective. Operators were allowed to work in the Solid Processing Pits without wearing effective respiratory protection to protect them from potential exposures to hazardous chemicals generated from the treatment processes including hydrogen sulfide gas.
