29 CFR 1910.165(b)(1):The employee alarm system did not provide warning for necessary emergency action as called for in the emergency action plan, or for reaction time for safe escape of employees from the workplace or the immediate work area, or both: (a) On or about April 5, 2022 in the MR3 Unit of the Covestro chemical manufacturing complex in Baytown, Texas, workers were exposed to toxic fumes from phosgene chemical release when the employee alarm was not sounded to allow reaction time for safe escape of employees from their immediate work area(s), as called for in the Emergency Action Plan.
