29 CFR 1910.212(a)(3)(ii):Point(s) of operation of machinery were not guarded to prevent employee(s) from having any part of their body in the danger zone(s) during operating cycle(s): a) Chocolate Manufacturing Area: On or about 10/28/21, the bottom roller located above the catch tray of the Refiner Machine was not guarded to protect employees against ingoing nip points between the bottom roller and guard of the top roller. Employees have to scoop excess chocolate shavings out of the tray next to the unguarded roller. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
