29 CFR 1910.502(k)(1)(iii):Employer(s) did not ensure that all air filters are rated Minimum Efficiency Reporting Value (MERV) 13 or higher, if compatible with the HVAC system(s). On or about July 21 through July 30, 2021, the employer failed to ensure that all air filters are rated Minimum Efficiency Reporting Value (MERV) 13 or higher. Before using the MERV 13, the employer was using air filters that were rated MERV 8. Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
