29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. a. On or about March 23, 2021, and at times prior, the employer did not ensure that employees installing reinforcing steel to previously installed reinforced steel uprights were protected from cave-in and struck-by hazards while working in-between an unprotected excavation wall and a rebar wall.
