29 CFR 1926.1203(d): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with �1926.1204 implemented at the construction site. On or about October 13, 2020, and at times prior thereto, employees were working in a sewer line manhole, a permit required confined space, without a written permit space entry program, exposing employees to hazards such as, but not limited to, flammable gases, oxygen deficient atmosphere, or toxic air contaminants.
