29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in a possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employees were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a. On or about August 27, 2020, at the jobsite, employees were directed to work in a trench after the foreman-competent person had completed an inspection of the trench site and noticed cave-in hazards without the hazards being corrected. The hazards included no cave-in protection, cracks along the walls, no means of egress and struck-by hazards.
