29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (0.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) On or about July 16, 2020, and at times prior, the employer, DBS, Inc. dba Colorado Structural Repair, did not ensure excavated material was kept at least 2 feet from the edge of excavations so as to protect employees from exposure to struck-by hazards due to material rolling or falling into excavations. Excavated material, including large pieces of soil, were at the edge of open excavations.
