29 CFR 1926.1203(d):(d) If any employer decides that employees it directs will enter a permit space, that employer must have a written permit space program that complies with �1926.1204 implemented at the construction site. The written program must be made available prior to and during entry operations for inspection by employees and their authorized representatives. a) On or about June 29, 2020, at the above address, the employer did not ensure that a written permit-required confined space program, compliant with the requirements of 29 CFR 1926.1204 and specific to elevator pit entry, was developed prior to allowing an employee to work in the pit of the freight elevator system (a permit-required confined space), thereby exposing an employee working in the elevator's pit to struck-by hazards from overhead materials and equipment.
