29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) Work site was located at 321 NJ 440, Jersey City, NJ 07305 Employees were working in an open trench that had the spoils piles set less than 2 feet from the edge of the trench. The spoils piles were approximately three feet high and contained debris including large rocks. The spoil piles were set on the edge of the sidewall of the trench. Violation was observed on or about February 27, 2020.
