29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection was not conducted by the competent person prior to the start of work and as needed throughout the shift: a. On or about December 20, 2019, at the jobsite, prior to the employees being directed to enter a trench, which measured 9 feet 4 inches deep and 122 feet long, the trench was not inspected by a competent person in the morning, during the day or after lunch. The trench had cracks and fissures along the walls, there was not a safe means of egress, the walls were vertical, and the type C soil had been previously disturbed.
