29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: PRODUCTION AREA: On or about and at times prior to August 22, 2019, the employer had not developed and implemented a hearing conservation program. Employees in the Tape Edge, Upholstery, and Framing Departments were exposed to noise levels in excess of 85 dBA over an 8-hour period. Employee #1, working in the Framing Department, was exposed to continuous noise levels at 109.5% of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 255 minute sampling period on September 3, 2019. Exposure calculations included a zero increment for the time not sampled. Employee #2, working in the Framing Department, was exposed to continuous noise levels at 48.7% of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 295 minute sampling period on September 3, 2019. Exposure calculations included a zero increment for the time not sampled. Employee #3, working in the Upholstery Department, was exposed to continuous noise levels at 48.7% of the permissible daily noise exposure (8-hour time-weighted average sound level of 85 dBA) during the 255 minute sampling period on September 3, 2019.
