29 CFR 1910.334(a)(2)(ii): There was a defect or evidence of damage that could have exposes an employee to injury and the defective or damaged item was not removed from service: On or about April 3, 2019, at Stewart Construction, L.L.C, located at 1725 Destrehan Ave. Harvey, LA, Defective, and damaged wires that could have exposed an employee to injury were not removed from service. Instance A By the trailer used as a painting booth, the employer allowed a damaged and spliced cord to transfer current from the sandblasting building to the painting booth. Instance B In the trailer used as a painting booth, the employer allowed damaged extension cord to be used to power the paint mixing machine. Instance C At the mechanic shop, the employer allowed damaged extension cord to be used to power a wall fan.
