29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form. Where the employer could not identify or reasonably estimate the employee exposure, the employer did not consider the atmosphere to be IDLH: On or about March 4, 2019, and at times prior thereto, at the tank battery train #7, employees performed maintenance and/or repairs to a level controller/float on the heater treater oil boot and peanut valve and the employer did not evaluate and/or identify the respiratory hazards on site.
