29 CFR 1910.1053(e)(1): The employer did not establish a regulated area wherever an employee's exposure to airborne concentrations of respirable crystalline silica was, or could have been reasonably expected to be, in excess of the PEL: a. On or about January 16, 2019, an employee operated a handheld Makita angle grinder, model 9565CV, while grinding, cutting, and polishing quartz and stone in the shop fabrication area and was exposed to Respirable Crystalline Silica at a Time Weighted Average (TWA) of 1096.9 micrograms per cubic meter (µg/m3), 22 times the permissible exposure limit of 50.0 µg/m3. The sampling was performed for 418 minutes on January 16, 2019. The employer did not establish a regulated area.
