OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that adequate precautions were not taken to prevent struck-by injuries from the operation of heavy equipment. Jobsite: Precautions were not taken to prevent struck-by injuries from heavy equipment performing grading work. On December 7, 2018, a laborer was fatally injured when he was struck by a bulldozer. The bulldozer operator was performing road grading work which requires the operator to focus on the bulldozer blade. Road grading work also requires the laborer to work near the bulldozer on an ongoing basis as s/he measures surface elevations, removes rocks from the bulldozer path, etc.
