29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart. The employer is failing to provide a protective system for employees of the company that were in an excavation exposing them to the hazards of an excavation collapse. Employees working in an excavation repairing piping which was not sloped or benched in accordance with appendices A and B. Sloping or benching for excavations greater than 20 feet deep were not designed by a registered professional engineer. The slopes measured approximately 45 degrees or 1:1 ratio for B type soil and the soil type was C according to the foreman. The sloping was not designed by a Registered Professional Engineer due to lack of tabulated data for the protective system. This was most recently documented at 150th St, and Capehart Rd., Springfield, Nebraska on or about October 18, 2018. The excavation was not appropriately sloped nor was there a protective system in place on the North and West sides of the excavation. Employees were working in the excavation with limited forms of protection for all sides of the excavation.
