29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems. (a) Mountain Top Homes at 4273 Spruce Way in Vail CO 81657: On or before August 31, 2018, the employer did not ensure that daily inspections of the trench were conducted by a competent person. The employer failed to identify hazardous conditions that would require the use of a trench box or other means of shoring. These hazardous conditions included but are not limited to: Type C soil, pavement over hang, and potential traffic disturbances. Employees were installing a water line in a trench more than 6 feet deep without any means of shoring in Type C soil. This condition exposed employees to cave-in and struck-by hazards.
