29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: a. On or about 6/14/18, at 4425 E. Fletcher Ave in Tampa, FL, the foreman, who was also the competent person noticed fissures and cracks along the unprotected walls of a 10 foot deep trench, in type C soil, while conducting his daily inspection and still allowed employees and himself to work in a trench without cave-in protection.
