29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: On or about May 11, 2018, employees were exposed to struck-by and combustible dust hazards when the employer's confined space program said that there were no permit-required confined spaces at the facility that were accessed by the employees. However, employees enter the bag house for maintenance and to change out the bags. Employees working in the top of the bag house enter/exit through a door that is not full size, exit the bag house by coming down a ladder, perform lockout/tagout prior to entry to avoid being struck by a rotating sweep arm, fans, and/or other equipment, and are exposed to a combustible dust if the air is dust laden. In addition, there were balers in the baler department, bowl/plate press department, and the printing press department which would require lockout/tagout before entry. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
