29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: The employer is failing to protect employees from excavated materials that could pose a hazard by falling into excavations where employees are working. The most recent occurrence was evident during the inspection conducted on December 12, 2017 at a jobsite located at 20619 Pine St, Elkhorn, NE 68022. The employer has two different trenches at the jobsite. While both trenches have the spoils piles located within 2 feet of the edge only the larger trench has a large enough spoils pile to pose a cave-in hazard.
