29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems was not performed by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. a) Crawl Space - On or about March, 26, 2016, daily inspections of excavations, the adjacent areas, and protective systems were not performed by a competent person designated by the employer where employees were exposed to possible cave-ins from inadequate protective systems, potential for hazardous atmospheres, and inadequate safe egress. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the Certification of Corrective Action Worksheet), in addition, documentation demonstrating the abatement is complete must be included with your certification. This documentation may include, but is not limited to evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
