29 CFR 1910.146(c)(1): The employer did not evaluate the workplace to determine if any spaces were permit-required confined spaces: a) Water Treatment area; On or about February 16, 2016 and at times prior thereto, the employer exposed employees to confined space hazards including but not limited to engulfment, oxygen deficiency and physical hazards in that the employer allowed employees to enter a pit where the sump pump for the water used to cool the copper tubing is located without first evaluating the space to determine if it is a permit required confined space. b) Make-up water pump pits - On or about February 16, 2016 and at times prior thereto, the employer exposed employees to confined space hazards including but not limited to engulfment, oxygen deficiency and physical hazards in that the employer allowed employees to enter a pit where the sump pump for the water used to cool the copper tubing is located without first evaluating the space to determine if it is a permit required confined space.
