29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: On or about March 28, 2015, an employee entered a permit required confined space in the main building to scrape off cement materials from the inside walls of a type 3 cement silo. The employer did not implement written permit required confined space procedures as addressed below for safe entry into the type 3 cement silo. An employee was exposed to possible asphyxiation and engulfment hazards. (a) Employee(s) entering type 3 cement silo, a permit required confined space in the main building such were exposed to possible asphyxiation hazards due to no air monitoring equipment being provided to test atmospheric conditions for employees to use, prior to entry. (b) Before entry was authorized into the type 3 cement silo a, permit required confined space the employer did not document the completion of measures required by preparing an entry permit to ensure that hazards associated permit required confined spaces were recognized, evaluated, and controlled prior to entering. (c) The employer did not provide training to employees assigned to be attendants to recognize, evaluate, and control hazards associated entry into a permit required confined space entry. (d) The employer did not evaluate the rescuers proficiency with rescue-related tasks and equipment to retrieve an entrant from a permit required confined space.
