29 CFR 1910.421(d)(2): Planning of a diving operation did not include an assessment of the safety and health aspects of surface and underwater conditions, is applicable to the Construction Standard 29 CFR 1926.1071 which incorporates the General Industry Requirements: On or about December 18, 2014, at the jobsite, 1 East 11th Street - Slip 3, Riviera Beach, Florida 33404, the employer did not assess the manmade hazards of the underwater conditions such as, but not limited to, the jagged edges of metal and projections of rebar, marine life and the current caused by the water intakes of the nearby power plant in the diving location, and natural hazards such as the currents, water turbidity and tides.
