29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a) Facility Wide- The employer failed to ensure that employee(s) who operate the powered industrial trucks, such as stand-up forklifts, sit-down forklifts and walkie rider style pallet jacks, were trained, evaluated and certified to perform the tasks in a safe manner at least once every three years. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
