29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service, or were placed in service if the examination showed conditions adversely affecting the safety of the vehicle a.) On or before 5/31/2012, there was no requirement to examine fork lift trucks prior to used for the shift. Employees using company fork lifts knew of multiple mechanical problems, including bad brakes, and the fork lifts were never removed from service nor repaired until after an accident occurred. Abatement Certification and Documentation is required.
