29 CFR 1926.1101(l)(4)(i): Waste and debris and accompanying dust in an area containing accessible thermal system, surfacing asbestos containing material (ACM) or presumed asbestos containing material, or visibly deteriorated ACM was dusted or swept dry, or vacuumed without using a HEPA filter. a) Advanced Construction and Design Services, LLC: On or about April 11-12 , 2018, at the jobsite located at 1650 W. Irving Park Rd. Chicago, Illinois, the employer did not ensure that waste, debris and accompanying dust in an area where employees performed Class I asbestos work, including disturbing or removing thermal system insulation, was not dry swept.
