29 CFR 1910.29(b)(1): The top edge height of top rails, or equivalent guardrail system members, were not 42 inches, plus or minus 3 inches, above the walking-working surface: At the worksite located at N 1031 Topping Ave, Kansas City, Missouri 64120 employees were exposed to fall hazards when carrying out there daily work activities such as buy not limited to facility operations, maintenance, and housekeeping in the grain elevator. The employer did not ensure that the guard rail systems top rail or equivalent members were 42 inches plus or minus 3 inches above the walking-working surface. Instances include but are not limited to: Instance 1. Employees were using guard rail systems with inadequate top rails while traveling above moving conveyor belts while carrying out their daily work activities such as but not limited to maintenance, operator, and housekeeping activities on the new house bin deck/floor level and similar top rails in old house bin floor/deck. The top rails are located at both the north and south belts. Instance 2. Employees were using guard rail systems with inadequate top rails while crossing over moving conveyor belts to conduct their daily work activities such as but not limited to maintenance, operator, and housekeeping activities in the basement of the grain elevator. There were 3 platforms on the north belt and 2 on the south belt.
