29 CFR 1910.146(k)(1)(v): An employer who designates rescue and emergency services, pursuant to paragraph (d)(9) of 1910.146, shall: Provide the rescue team or service selected with access to all permit spaces from which rescue may be necessary so that the rescue service can develop rescue plans and practice rescue operations. (a) On January 10, 2025, at the Emerald Transformer job site in Twinsburg, OH: The employer did not ensure that outside rescue services were provided with prior access to the permit space prior to authorizing entry of a company employee into rail tank car GATX 28821, a permit-required confined space.
