29 CFR 1926.1101(g)(1)(i): The employer did not use engineering controls and work practices in all operations covered by 29 CFR 1926.1101, regardless of the levels of exposure, in the form of vacuum cleaners equipped with high efficiency particulate air (HEPA) filters to collect all debris and dust containing asbestos containing material and presumed asbestos containing material: (a) On or about July 27, 2016, at work site at 46-10 61st Street, Apt. 15E, Woodside, NY 11377 Employer instructed employees to remove asbestos-containing 9" x 9" floor tile without providing a HEPA vacuum cleaner to clean up dust and debris. ABATEMENT CERTIFICATION REQUIRED PURSUANT TO 29 CFR 1903.19.
