29 CFR 1910.1000(e): Equipment and/or technical measures used to keep the exposure of employees to air contaminants within the limits prescribed in Subpart Z of 29 CFR 1910 were not approved by a competent industrial hygienist or other technically qualified person: The spice room employee total dust exposure was 46.13 mg/m3, as an 8hr time weighted average. The employee was sampled on January 28, 2011 and was sampled for 352 minutes, the remaining 128 minutes was calculated as 0 (zero) exposure time. ABATEMENT CERTIFICATION REQUIRED PER 29 CFR 1903.19(c) ABATEMENT NORMALLY WILL BE MULTI-STEP AS FOLLOWS. STEP 1: Effective respiratory protection shall be used by exposed STEP 2: Submit to the AREA DIRECTOR a written, detailed plan of abatement outlining a schedule for the implementation of engineering and/or administrative measures to control employee exposure to Hazardous Substance as referenced in this citation. This plan shall include, at a minimum, target dates for the following actions which must be consistent with the abatement dates required by this citation: (1)Evaluation of engineering/administrative control options; (2) Selection of optimum control methods and completion ofdesign; (3) Procurement, installation and operation of selected control measures; (4) Testing and acceptance or modification/redesign of controls. NOTE: All proposed control measures shall be approved for each particular use by a competent Industrial Hygienist or other technical qualified person. Ninety (90) day progress reports are required during the abatement period. (The 90-day requirement for the submission of progress reports may be shortened or lengthened by the Area Director, depending on the specific circumstance). STEP 3 Abatement shall have been completed by the implementation of feasible engineering and/or administrative controls upon verification of their effectiveness in achieving compliance.
