29 CFR 1910.1053(j)(1):The employer did not ensure that each employee was trained in accordance with the provisions of Hazard Communication Standard(HCS) and paragraph (j)(3) of this section: Fabrication Shop: Employees exposed to crystalline silica in excess of the 25 mcg/m3 action level, were not provided training on crystalline silica hazards as part of hazard communication training and were not provided training on the required items listed out in 1910.1053(j)(3) a. On December 3, 2025, an employee was exposed to 50 mcg/m3 as an 8-hour time weighted average in excess of the 25 mcg/m3 8-hour time weighted average action level. b. On December 3, 2025, an employee was exposed to 41 mcg/m3 as an 8-hour time weighted average in excess of the 25 mcg/m3 8-hour time weighted average action level.
