29 CFR 1910.28(b)(6)(i): The employer did not ensure that each employee less than 4 feet (1.2 m) above dangerous equipment is protected from falling into or onto the dangerous equipment by a guardrail system or a travel restraint system, unless the equipment is covered or guarded to eliminate the hazard. At the worksite located at N 1031 Topping Ave, Kansas City, Missouri 64120 employees were exposed to fall hazards while conducting grain handling operations. The employer did not ensure employees working less than 4 feet above dangerous equipment were protected by adequate guard rail travel or restraint systems that were neither covered nor guarded to eliminate the hazard. Instances include but are not limited to: Instance 1. Employees traveling over moving conveyor belts ascending through the floor while carrying out their daily work activities such as but not limited to maintenance, facility operator, and housekeeping activities on the new house bin deck/floor level and similar activities in the old house bin deck/floor. Instance 2. Employees used platforms with inadequate guard rail systems to cross over conveyor belts used for transferring grain to conduct their daily work activities such as but not limited to maintenance, facility operator, and housekeeping activities in the basement of new house. There were 5 cross over platforms, 3 on the north belt and 2 on the south belt.
