29 CFR 1910.28(b)(3)(iv): The employer did not provide that each employee be protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toeboards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used: a) On or about January 21, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, did not ensure employees were protected from fall hazards into ladderway platform holes at least 12 feet above the lower ground level. Employees were required to access and perform maintenance work on platforms in the top and bottom lift housing structures on the American Eagle Chair Lift and Excelerator Chair Lift. The ladderway entrance points to the housing platforms were not guarded on all sides by guardrails and self-closing gates or offsets. These conditions exposed employees to fall hazards.
