29 CFR 1910.95(k)(1):The employer did not train each employee who is exposed to noise at or above an 8-hour time-weighted average of 85 decibels in accordance with the requirements of 29 CFR 1910.95(k). The employer did not institute a training program and ensure employee participation in the program: Location: Capsule Room, 15 Whitehall Road, Andover, New Jersey 07821 a) The employer did not train employees in accordance with the requirements of 29 CFR 1910.95(k) who are exposed to noise levels above the action level. On January 4, 2024 three employees in the capsule room working near and operating the Bosch GKF1500 Capsule Filler Machine were exposed to noise levels that were equivalent to 68.3%, 73.5%, and 69% of the allowable dose of 50%, or 85dBA for an 8 hour Time Weighted Average. Employees were exposed to noise levels of 87.2 dba, 87.7 dba, and 87.3 dba, respectively. Employees were sampled for 362 minutes, 298 minutes, and 291 minutes. Zero exposure is assumed for the unsampled periods of 118 minutes, 182 minutes, and 189 minutes. Violation occurred on or around January 4, 2024
