29 CFR 1926.1428(a): The employer of the signal person did not ensure each signal person met the Qualifications Requirements (paragraph (c) of this section) prior to giving any signals. On or about February 26, 2020, and times prior thereto, the employer did not ensure a qualified evaluator assessed each signal person to determine whether the signal person met the qualification requirements, prior to giving any signals. This exposed employees to struck-by hazards.
