29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s) Workplace, Loading Dock - defective powered industrial trucks were not taken out from service, such as, but not limited to: a) Nissan 50, #5 (orange) had a broken off LPG tank location pin. The stub of the pin left was too short to reach the tank to keep it from rotating; on or about 03/27/12 b) Clark CMP 30, #1 (green) Serial CP23OL-0154-6872KF Additionally, the LPG tank was mounted improperly without mounting the tank on the location pin. The back warning beacon was not operable; on or about 03/27/12 c) Poosan Daewoo, G25E-3 #4 (yellow) Serial KP-00509 Additionally, the LPG tank was mounted improperly without mounting the tank on the location pin. The location pin on this machine was repaired with a pin that was too large in diameter to fit the standard hole in LPG tanks. The right rear light was not operating; on or about 03/27/12 Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
