29 CFR 1910.119(n): The employer did not establish and implement an emergency plan for the entire plant in accordance with the provisions of 29 CFR 1910.38: a) Establishment - The employer's written emergency response plan did not identify a second employee assembly area on the side of the plant opposite the carton storage warehouse where evacuated employees would assemble if the wind direction was from the east (towards the carton storage warehouse). On or about 2/8/12. b) Establishment - There was no fixed emergency evacuation alarm that when activated would notify all employees of an evacuation in a timely manner. On or about 2/8/12. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
