29 CFR 1910.28(b)(2)(i): 29 CFR 1910.28(b)(2)(i): The employer did not ensure that each employee in a hoist area is protected from falling 4 feet (1.2 m) or more to a lower level by one of the systems listed in 29 CFR 1910.28(b)(2)(i)(A)-(C): a) On or about January 21, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, did not ensure employees were protected from fall hazards while positioned on working platforms approximately 10 feet above the lower ground level in maintenance shop locations for chair lifts including, but not limited to, the American Eagle, the American Flyer, and the Super Bee. Employees were required to access working platforms in these locations to perform maintenance work on lift chairs suspended from underhung hoists. The platforms had floor cut-outs that measured approximately 5 feet in width and 20 feet in length. A means of protecting employees from falling through the cut-out spaces had not been implemented. These conditions exposed employees to fall hazards of approximately 10 feet.
