29 CFR 1910.1053(d)(1):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section: a) Busch Products Inc., 110 Baker Street, Syracuse, NY 13206. On or about October 17, 2024, the employer did not assess the exposure of the Park Industries Titan machines operator who was reasonably expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of 29 CFR 1910.1053. The employee was exposed to 79.95 micrograms per cubic meter (mcg/m3) of respirable crystalline silica, eight hour time weighted average (TWA), approximately 1.6 times the OSHA permissible exposure limit of 50 mcg/m3. The sampling period was for 468 minutes. A zero increment is included for the 12 minutes not sampled. b) Busch Products Inc., 110 Baker Street, Syracuse, NY 13206. On or about October 17, 2024, the employer did not assess the exposure of the stone polisher who was reasonably expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of 29 CFR 1910.1053 for employees who work as stone polishers. The employee was exposed to 80.75 micrograms per cubic meter (mcg/m3) of respirable crystalline silica, eight hour time weighted average (TWA), approximately 1.6 times the OSHA permissible exposure limit of 50 mcg/m3. The sampling period was for 467 minutes. A zero increment is included for the 13 minutes not sampled. c) Busch Products Inc., 110 Baker Street, Syracuse, NY 13206. On or about October 17, 2024, the employer did not assess the exposure of the Park Industries SABERjet XP CNC Sawjet machines operator who was reasonably expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of 29 CFR 1910.1053. The employee was exposed to 75.54 micrograms per cubic meter (mcg/m3) of respirable crystalline silica, eight hour time weighted average (TWA), approximately 1.5 times the OSHA permissible exposure limit of 50 mcg/m3. The sampling period was for 459 minutes. A zero increment is included for the 21 minutes not sampled. d) Busch Products Inc., 110 Baker Street, Syracuse, NY 13206. On or about October 17, 2024, the employer did not assess the exposure of the Park Industries Yukon II Semi-Automatic Bridge Saw shop employee who was reasonably expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of 29 CFR 1910.1053. The employee was exposed to 53.17 micrograms per cubic meter (mcg/m3) of respirable crystalline silica, eight hour time weighted average (TWA), approximately 2.12 times the OSHA action level of 25 mcg/m3, and potentially over the permissible exposure limit of 50 mcg/m3. The sampling period was for 464 minutes. A zero increment is included for the 16 minutes not sampled. e) Busch Products Inc., 110 Baker Street, Syracuse, NY 13206. On or about October 17, 2024, the employer did not assess the exposure of the shipping and receiving supervisor who was reasonably expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of 29 CFR 1910.1053. The employee was exposed to 28.38 micrograms per cubic meter (mcg/m3) of respirable crystalline silica, eight hour time weighted average (TWA), potentially 1.13 times the OSHA action level of 25 mcg/m3.
