29 CFR 1926.1101(h)(2)(i): The employer failed to implement a respiratory protection program in accordance with 29 CFR 1910.134(b) through (d) [except (d)(1)(iii)], and (f) through (m), which covers each employee required by 29 CFR 1926.1101 to use a respirator: a) On or about August 21, 2024, the employer failed to establish and implement a written Respiratory Protection Program for employees conducting activities involving the removal of pipe insulation containing asbestos, as respirators were required by the standard when conducting Class I asbestos work.
