29 CFR 1910.212(a)(3)(ii): Point of operation guards were not designed and constructed as to prevent the operator from having any part of their body in the danger zone during the operating cycle: (a)On or about May 13, 2024, and at times prior, the employer did not ensure employees were protected from amputation hazards in that, the fabricated frame barrier guard on the Wysong Mechanical Shear Model # 1025, Serial # P37-740 was not rigid and could be pulled away from the machine allowing access to the point of operation. The guard was easily defeated in that, it was hinged and an operator could cycle the machine and shear metal stock with the guard in the "up" position. This condition exposed employees to amputation and laceration hazards. (b)On or about May 13, 2024, and at times prior, the employer did not ensure the point of operation on the Di-Acro Model # 150-10, 150-ton press brake was guarded to prevent employees from having any part of their body in the danger zone during operation. The press brake was cycled using a foot pedal placed in close proximity to the point of operation. Additionally, the rear of the machine was not guarded to prevent workers access to the point of operation. Employees were also not protected by other controls such as restraints, presence sensing devices, electromechanical sensing devices, two hand controls nor was a moveable physical barrier in place. This hazard exposed the employees to an amputation hazard and laceration hazards. (c)On or about May 13, 2024, and at times prior, the employer did not ensure the point of operation on the Euromac CX 750/30 CNC punch press was guarded to prevent employees from having any part of their body in the danger zone during operation. The punch press was cycled using a foot pedal placed in close proximity to the point of operation. Employees were not protected by controls such as restraints, presence sensing devices, electromechanical sensing devices, two hand controls nor was a moveable physical barrier in place. This hazard exposed the employees to an amputation hazard and laceration hazards.
